Terms of service

We give you software that builds games. You describe what you want, or show us a video, and our agents write and build a game for you. You can publish it to the Tapugo Store, export it to the App Store and Google Play, and run paid tests against it.

You own the games you make here, including the code, the art you upload and the art generated for you. We claim no ownership over them and we do not use your private projects to train models.

We need a limited licence to host, build and display your work so that the product can function, and to show a game you publish to the Tapugo Store to the people who play it. That licence ends when you delete the work.

Credits are prepaid units of compute. One credit is one cent of the work our machines do on your behalf. Plans grant credits monthly. Top ups are bought outright.

• Plan credits expire at the end of the period they were granted for.
• Top up credits do not expire, and are spent after plan credits.
• Credits are consumed as work is performed. Credits already spent on work we performed are not refundable.
• If a build fails because of a fault on our side, the credits it consumed go back to your balance.
• Credits have no cash value and cannot be transferred or sold.

Plans renew monthly until cancelled. You can cancel at any time and keep access until the end of the period you have paid for. We do not refund part months. If we raise a price we will tell you before it applies to you.

A person at Tapugo plays every release before it appears in the Tapugo Store. Approval is tied to the exact build you submitted, so editing your game means the new version is reviewed again.

We can decline a release, or remove one that is already live, if it breaks the rules below. If we do, we will tell you why.

• Upload material you do not have the rights to, or clone a game asset for asset.
• Make anything illegal, hateful, or sexual involving minors.
• Use the platform to attack, scrape or overload anyone, including us.
• Resell access to your account, or share credentials with people outside your studio.
• Try to get around credit limits, review, or the rate limits on any part of the service.

Breaking these can cost you your account. Serious cases, particularly anything involving minors, are reported to the authorities.

Publishing to the App Store or Google Play means agreeing to their terms as well as ours. They decide what appears on their stores, not us, and we cannot promise a submission will be accepted.

When you run a paid test you are buying advertising through Meta with your credits. We quote the cost up front and return whatever Meta does not spend. Meta reviews every ad and can reject one. Results are measurements, not predictions, and thin results are marked as thin so you do not build on noise.

We work hard to keep the service up and we do not promise it will never be down. Builds run on shared infrastructure and can queue. Paid plans get priority in that queue.

The service is provided as it is. To the extent the law allows, our total liability to you is limited to what you paid us in the twelve months before the claim. We are not liable for lost profits or lost revenue, including from a game that did not sell.

You can close your account at any time. We can suspend or close an account that breaks these terms, and we will explain why unless the law stops us. If we close your account without cause we will refund unused prepaid credits.

Tapugo Games Inc. is incorporated in Canada. These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in it, without regard to conflict of law rules. Disputes go to the courts of Ontario, and you and we each agree to their jurisdiction.

If you are a consumer, nothing here takes away rights your local consumer protection law gives you and does not let us contract out of. For consumers in Ontario that includes the Consumer Protection Act, 2002.
